Point of argument

Our client (participant of the electronic auction) was improperly denied participation in the electronic auction by the Customer. Purpose - to appeal against the Customer actions with FAS.

Plaintiff’s case

The company applied for participation in the electronic auction. In accordance with the provisions of the Law on the Contract System, the application indicated the characteristics corresponding to the values established by the documentation for such an auction. However, the commission of the Customer decided not to allow the participant of the electronic auction to participate in such an auction. The company filed a complaint on the actions of the Customer with FAS.

Defence

The Customer justified his decision not to allow an e-auction participant to participate in such an auction alleging that the information provided in the application was insufficient. Moreover, according to the Customer, it was unreliable.

• preparation and filing of the claim and related documents in FAS;
• Applicant’s interests representation in FAS.

Court judgement

The antimonopoly body carefully reviewed the materials and positions of the parties and recognized the complaint of the participant of the electronic auction well pleaded. The Customer received an order to eliminate the breach of competition legislation.
