Point of argument

Recovery of losses and the borrowed funds usage interest under the service agreement for processing of electronic statements.

The reason for going to court was the Contractor’s evasion from the obligation to return the funds previously transferred to him by the Customer.

Plaintiff’s case

The Plaintiff based his claims on the fact that the Defendant did not fulfill the obligations under the contract properly (that is, did not transfer the goods to the Plaintiff, did not return the sum of money), as a result of which the Plaintiff suffered losses.

Defence

The Defendant considered some of the evidence to be fabricated and excluded from the case file.

Problem solution stages

• preparation of a letter of claim;
• preparation and filing of the claim and related documents to court;
• Plaintiff’ interests representation in court.

Court judgement

The claim was settled in part.  Lawyers from the legal bureau won in court the compensation for all losses incurred by the Customer under the service agreement (processing of electronic statements).
